Product Safety Standards (Pedal Bicycles) Amendment Regulations 2003

Pursuant to section 29(2) of the Fair Trading Act 1986, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Consumer Affairs, makes the following regulations.

  • These regulations come into force on the day after the date of their notification in the Gazette.

3 Application
  • Regulation 4(2) of the principal regulations is amended by adding the following paragraph:

    • (f) is secondhand.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the day after the date of their notification in the Gazette, amend the Product Safety Standards (Pedal Bicycles) Regulations 2000 ( the principal regulations).

The principal regulations declare the Australian/New Zealand Standard AS/NZS 1927:1998 Pedal bicycles—Safety requirements to be a product safety standard for the goods to which the principal regulations apply for the purposes of section 29 of the Fair Trading Act 1986.

These regulations exclude secondhand pedal bicycles from the application of the principal regulations. This means that a person who supplies, or offers to supply, or advertises to supply, a secondhand pedal bicycle does not have to comply with the product safety standard prescribed under the principal regulations when supplying, or offering to supply, or advertising to supply that secondhand pedal bicycle.
