Health and Safety in Employment Amendment Regulations 2003


Note

These regulations are administered in the Department of Labour.


Pursuant to section 21 of the Health and Safety in Employment Act 1992, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Certificates of competence
  • Regulation 27(1)(b) and (3) of the principal regulations is revoked.

4 Requirements of applicants
  • Regulation 31(a) of the principal regulations is amended by omitting the words or regulation 33(a) to (d).

5 Regulation 33 revoked
  • Regulation 33 of the principal regulations is revoked.

6 Application of regulations 51 to 53
  • (1) The heading to regulation 50 of the principal regulations is amended by omitting the words 51 to, and substituting the words 52 and.

    (2) Regulation 50 of the principal regulations is amended by omitting the words 51 to in both places where they occur, and substituting in each case the words 52 and.

7 Regulation 51 revoked
  • Regulation 51 of the principal regulations is revoked.

8 Offences
  • Regulation 70(1) of the principal regulations is amended by omitting the expression 51(1),.

9 Schedule 2 amended
  • Schedule 2 to the principal regulations is amended by omitting the item relating to Construction blaster.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the Health and Safety in Employment Regulations 1995 by revoking the provisions relating to construction blasters.

As a result of the coming into force of the Hazardous Substances (Fireworks, Safety Ammunition, and Other Explosives Transfer) Regulations 2003 (SR 2003/176), handlers of explosives must now comply with the requirements imposed by regulations made under the Hazardous Substances and New Organisms Act 1996. Consequently, any regulations made under the Health and Safety in Employment Act 1992 that impose certification requirements on handlers of explosives are no longer necessary.
