Pursuant to sections 63 and 163 of the Dairy Industry Restructuring Act 2001, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Agriculture after consultation with Livestock Improvement Corporation Limited, makes the following regulations.

1 Title
  • These regulations are the Dairy Industry (Livestock Improvement Corporation Levy) Regulations 2003.

2 Commencement
  • These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Levy
  • (1) Livestock Improvement Corporation Limited must pay a levy of $78,036 to the Crown.

    (2) The levy is a debt due to the Crown and is calculated to meet the costs of the New Zealand Dairy Core Database Access Panel for the financial year 1 June 2003 to 31 May 2004.

4 Payment
  • The levy is payable as follows:

    • (a) by payment of $58,527 by 14 days after the commencement of these regulations:

    • (b) by payment of $19,509 by 19 March 2004.

5 GST included
  • The levy under regulation 3 includes goods and services tax.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations come into force 28 days after the date of their notification in the Gazette.

Regulation 3 specifies the levy payable by the Livestock Improvement Corporation Limited for the financial year 1 June 2003 to 31 May 2004.

The purpose of the levy is to recover the estimated costs of the New Zealand Dairy Core Database Access Panel established by regulation 13 of the Dairy Industry (Herd Testing and New Zealand Dairy Core Database) Regulations 2001.

Regulation 4 stipulates how and when the levy is payable.
