Terrorism Suppression Amendment Act 2003 Commencement Order (No 2) 2003

Pursuant to section 2(1) of the Terrorism Suppression Amendment Act 2003, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title
  • This order is the Terrorism Suppression Amendment Act 2003 Commencement Order (No 2) 2003.

2 Commencement
  • This order comes into force on the day after the date of its notification in the Gazette.

3 Interpretation
4 Provisions commencing on 18 January 2004
  • (1) The following provisions come into force on 18 January 2004:

    • (b) sections 3, 5, and 16 of the amendment Act:

    (2) The provisions referred to in paragraph (b) of subclause (1) come into force on 18 January 2004 to the extent only that they insert into the principal Act the provisions referred to in paragraph (c) of that subclause.

    (3) Subclause (2) overrides subclause (1)(b).

5 Provisions commencing on 17 February 2004
  • The following provisions come into force on 17 February 2004:

    • (a) to the extent that they are not already fully in force immediately before the close of 16 February 2004, the provisions of the amendment Act referred to in clause 4(1)(b):

    • (b) all provisions of the amendment Act that—

      • (i) are not referred to in clause 4(1)(b); and

      • (ii) are not already in force immediately before the close of 16 February 2004:

    • (c) sections 3(b)(v) and 13B and Schedule 2B of the principal Act.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings into force all provisions of the Terrorism Suppression Amendment Act 2003 not already in force.

Provisions relating solely to the Convention on the Marking of Explosives for the Purpose of Detection come into force on 17 February 2004. All other provisions come into force on 18 January 2004.
