Pursuant to section 55 of the Maori Trust Boards Act 1955, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title
  • This order is the Taitokerau Maori Trust Board Order 2003.

2 Commencement
  • This order comes into force on the day after the date of its notification in the Gazette.

3 Interpretation
  • In this order, unless the context otherwise requires,—

    Trust Board means the Taitokerau Maori Trust Board.

4 Background
  • (1) An election for the membership of the Trust Board was held during October and November 2002.

    (2) From the 8 divisions, only 5 members were elected, as the nominations for the following divisions were declared to be invalid:

    • (a) Te Aupouri:

    • (b) Ngapuhi ki Whangaroa:

    • (c) Ngapuhi ki Waimate.

    (3) Nominations for the election of members for the divisions specified in subclause (2) were called for in February 2003.

    (4) Only 1 nomination was received for each division.

    (5) Because of section 48(2) of the Act, no election was necessary and the following persons were deemed to have been duly elected for the following divisions:

    • (a) George Witana for Te Aupouri:

    • (b) Poihakana Syd Kira for Ngapuhi ki Whangaroa:

    • (c) Rihari Dargaville for Ngapuhi ki Waimate.

    (6) However, the deemed election of the members referred to in subclause (5) was irregular because it occurred after the election referred to in subclause (1).

5 Validation
  • The election of members referred to in clause 4(5) is, and has always been, valid despite the irregularity specified in clause 4(6).

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the day after the date of its notification in the Gazette, validates the 2003 election of members of the Taitokerau Maori Trust Board for the divisions of Te Aupouri, Ngapuhi ki Whangaroa, and Ngapuhi ki Waimate.
