Pursuant to section 14 of the Insolvency Act 1967 and to section 39(1) of the Supreme Court Act 2003, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • (1) These regulations are the Insolvency Amendment Regulations 2004.

    (2) In these regulations, the Insolvency Regulations 19701 are called the principal regulations.

2 Commencement
  • These regulations come into force on 1 April 2004.

3 Fees
  • Regulation 5 of the principal regulations is amended by revoking subclause (5), and substituting the following subclauses:

    • (5) The fees to be taken in respect of proceedings under the Act in the Court of Appeal are those prescribed by the Court of Appeal Fees Regulations 2001 in respect of proceedings in that Court.

    • (6) The fees to be taken in respect of proceedings under the Act in the Supreme Court are those prescribed by the Supreme Court Fees Regulations 2003 in respect of proceedings in that Court.

4 Forms
  • Schedule 1 to the principal regulations is amended by omitting the words Supreme Court wherever they occur in Forms 9, 10, 11, 12, 13, 14, 15, and 18, and substituting in each case the words High Court.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 April 2004, amend the Insolvency Regulations 1970. The amendments made are consequential on the passing of the Supreme Court Act 2003.
