Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Amendment Regulations 2004


Note

These regulations are administered in the Ministry of Fisheries.


Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on 1 April 2004.

3 Interpretation
  • (1) Regulation 2(1) of the principal regulations is amended by revoking the definition of licensed concession fish packing house, and substituting the following definition:

    licensed fish receiver's premises means—

    • (a) the premises of a licensed fish receiver located in the Southland region; or

    • (b) the premises of a licensed fish receiver not located in the Southland region, if the chief executive has authorised the premises to receive and process Southland concession area rock lobster for export.

    (2) Regulation 2(1) of the principal regulations is amended by omitting from the definition of Southland Concession Pack the words licensed concession fish packing house in each place where they occur, and substituting in each case the words licensed fish receiver's premises.

    (3) Regulation 2(1) of the principal regulations is amended by inserting, after the definition of Southland Concession Pack, the following definition:

    Southland region means The Southland Region as constituted by the Local Government (Southland Region) Reorganisation Order 1989 (Gazette, 1989, p 2430).

    (4) Regulation 2 of the principal regulations is amended by adding the following subclause:

    • (3) For the purposes of authorising premises to receive and process Southland Concession Area rock lobster for export, the chief executive may grant an authorisation subject to such terms and conditions as the chief executive thinks fit.

4 Concession relating to female rock lobster
  • Regulation 5C of the principal regulations is amended by omitting the words licensed concession fish packing house in each place where they occur, and substituting in each case the words licensed fish receiver's premises.

5 Processing and sale of Southland Concession Area rock lobster
  • (1) Regulation 5E (except subclause (3)(f)) of the principal regulations is amended by omitting the words licensed concession fish packing house in each place where they occur, and substituting in each case the words licensed fish receiver's premises.

    (2) Regulation 5E(3)(f) of the principal regulations is amended by omitting the words of the licensed concession fish packing house.

6 Restrictions on fishing methods
  • (1) Regulation 15I(1) of the principal regulations is amended by omitting the words horse mussel, and sea cucumber,.

    (2) Regulation 15I(2) of the principal regulations is amended by omitting the words deepwater crab,.

7 Schedule revoked
  • The Schedule of the principal regulations is revoked.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 April 2004, amend the Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Regulations 1986. The amendments—

  • omit references to licensed concession fish packing house, and substitute references to licensed fish receiver's premises. These amendments are consequential on the final repeal of the Meat Act 1981 on 1 July 2006; and

  • omit references to deepwater crab, horse mussels, and sea cucumber in regulation 15I, which places restrictions on fishing methods in quota management areas 5 and 6. These species are being introduced into the quota management system on 1 April 2004.
