Heavy Motor Vehicle Amendment Regulations (No 2) 2004


Note

These regulations are administered in the Ministry of Transport.


Pursuant to section 218 of the Land Transport Act 1998, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • (1) These regulations are the Heavy Motor Vehicle Amendment Regulations (No 2) 2004.

    (2) In these regulations, the Heavy Motor Vehicle Regulations 19741 are called the principal regulations.

2 Commencement
  • These regulations come into force on 3 May 2004.

3 Speed
  • Regulation 9 of the principal regulations is amended by revoking subclauses (1) to (2B), and substituting the following subclauses:

    • (1) A person must not operate a heavy motor vehicle at a speed exceeding 90 kilometres an hour.

    • (2) Subclause (1)—

      • (a) does not apply in respect of a motorcar; but

      • (b) does apply to a heavy motor vehicle that is being used to tow—

        • (i) a trailer or trailers (including a semi-trailer or semi-trailers); or

        • (ii) a vehicle (other than a motorcycle) normally propelled by mechanical power.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 3 May 2004, amend the Heavy Motor Vehicle Regulations 1974 by increasing the speed limit from 80 to 90 kilometres an hour for heavy motor vehicles that are towing a trailer or trailers (including a semi-trailer or semi-trailers) or towing a vehicle (other than a motorcycle) normally propelled by mechanical power.
