Fisheries (Auckland and Kermadec Areas Commercial Fishing) Amendment Regulations 2004


Note

These regulations are administered in the Ministry of Fisheries.


Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on 1 October 2004.

3 Interpretation
  • Regulation 2(1) of the principal regulations is amended by revoking the definition of green-lipped mussel spat.

4 Regulations revoked
  • Regulations 4B and 5E are revoked.

5 Restrictions on the taking of shellfish
  • (1) Regulation 22A(1) of the principal regulations is amended by omitting from the table the item relating to mussels.

    (2) Regulation 22A of the principal regulations is amended by adding the following subclause:

    • (4) The maximum daily weight limit specified for pipi in subclause (1) does not apply to quota management area 1A.

6 Offences
  • Regulation 24(1) of the principal regulations is amended by omitting the expression 5E,.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 October 2004, amend the Fisheries (Auckland and Kermadec Areas Commercial Fishing) Regulations 1986 to—

  • revoke certain regulations relating to green-lipped mussel, and remove commercial catch limits and daily limits for mussels:

  • provide that the maximum daily weight limit for pipi does not apply in quota management area 1A.
