Injury Prevention, Rehabilitation, and Compensation (Liability to Pay or Contribute to Cost of Treatment) Amendment Regulations 2004

These regulations are administered in the Department of Labour.


Pursuant to sections 324 of the Injury Prevention, Rehabilitation, and Compensation Act 2001, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on 19 September 2004.

3 Interpretation
  • (1) Regulation 3 of the principal regulations is amended by revoking the definition of nurse.

    (2) Regulation 3 of the principal regulations is amended by omitting from the definition of radiologist the word registered.

    (3) Regulation 3 of the principal regulations is amended by revoking the definition of registered specialist, and substituting the following definitions:

    scope of practice has the same meaning as in section 5(1) of the Health Practitioners Competence Assurance Act 2003

    specialist means a medical practitioner whose scope of practice includes 1 or more recognised branches of medicine.

    (4) Regulation 3 of the principal regulations is amended by revoking the definition of vocational registration.

4 Radiologists' costs
  • Regulation 12(2)(a) of the principal regulations is amended by omitting the words radiologist holds vocational registration in, and substituting the words radiologist's scope of practice includes.

5 Registered medical practitioners' costs
  • (1) The heading to regulation 13 of the principal regulations is amended by omitting the word Registered.

    (2) Regulation 13(1)(a) of the principal regulations is amended by omitting the word registered in each place where it occurs.

    (3) Regulation 13(1)(a)(ii) of the principal regulations is amended by omitting the words in respect of which he or she holds vocational registration, and substituting the words included in his or her scope of practice.

    (4) Regulation 13(1)(b) of the principal regulations is amended by omitting the word Registered.

6 Nurses' costs
  • Regulation 14(1)(b) of the principal regulations is amended by omitting the word Registered.

7 Registered medical practitioners' and nurses' costs for combined treatment
  • (1) The heading to regulation 15 of the principal regulations is amended by omitting the word Registered.

    (2) Regulation 15(1)(a)(ii) of the principal regulations is amended by omitting the word registered.

    (3) Regulation 15(1)(b) of the principal regulations is amended by omitting the word Registered.

    (4) Regulation 15(3) of the principal regulations is amended by inserting, before the word practitioner, the word medical.

    (5) Regulation 15(4) of the principal regulations is amended by inserting, before the word practitioner in each place where it occurs, the word medical.

    (6) Regulation 15(6) of the principal regulations is amended by inserting, before the word practitioner in both places where it occurs, the word medical.

    (7) Regulation 15(7) of the principal regulations is amended by inserting, before the word practitioner in the second place where it occurs, the word medical.

8 Registered specialists' costs
  • (1) The heading to regulation 16 of the principal regulations is amended by omitting the word Registered.

    (2) Regulation 16(1)(a) of the principal regulations is amended by omitting the word registered in both places where it occurs.

    (3) Regulation 16(1)(a)(ii) of the principal regulations is amended by omitting the words in respect of which he or she holds vocational registration, and substituting the words included in his or her scope of practice.

    (4) Regulation 16(1)(b) of the principal regulations is amended by omitting the word Registered.

9 Schedule amended
  • (1) The Schedule of the principal regulations is amended by omitting from the second column of item C1 the word registered.

    (2) The Schedule of the principal regulations is amended by omitting from the second column of item DE3 the words Specialist only, and substituting the words Conducted by a dentist whose scope of practice includes a dental speciality recognised by the Dentist Council of New Zealand.

    (3) The Schedule of the principal regulations is amended by omitting from the heading after items RX25 and MT5 the word Registered.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 19 September 2004, amend the Injury Prevention, Rehabilitation, and Compensation (Liability to Pay or Contribute to Cost of Treatment) Regulations 2003.

The amendments are technical changes to make terminology consistent with the Health Practitioners Competence Assurance Act 2003.

Most of the provisions of that Act come into force on 19 September 2004.
