Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Amendment Regulations (No 2) 2004

These regulations are administered in the Ministry of Fisheries.


Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
2 Commencement
  • These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Regulation 8 revoked
  • Regulation 8 of the principal regulations is revoked.

4 Kina season and quotas
  • Regulation 15F of the principal regulations is amended by revoking subclause (3).

5 Offences
  • Regulation 16(2) of the principal regulations is amended by—

    • (a) omitting the expression 8, ; and

    • (b) omitting the expression and (3).

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the Fisheries (Southland and Sub-Antarctic Areas Commercial Fishing) Regulations 1986.

Regulation 8, which sets our the minimum size of dredge oysters, is revoked because it is redundant. Limits are included in the Fisheries (Amateur Fishing) Regulations 1986 and the Fisheries (Commercial Fishing) Regulations 2001, which apply nationwide. Regulation 16, regarding offences, is consequentially amended.

Regulation 15F is amended to re-open an area previously closed to the taking of kina. Regulation 16, regarding offences, is consequentially amended.
