Fisheries (Commercial Fishing) Amendment Regulations (No 4) 2004


Note

These regulations are administered in the Ministry of Fisheries.


Pursuant to section 297 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

2 Commencement
  • These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Schedule 2 amended
  • Schedule 2 of the principal regulations is amended by—

    • (a) omitting from clause 4(a), the expression 89.96, and substituting the expression 133.88 ; and

    • (b) omitting from clause 4(c), the expression 89.96, and substituting the expression 133.88 ; and

    • (c) omitting from clause 17(1) and (2), the expression 3039.30, and substituting in each case the expression 2,008.20 ; and

    • (d) omitting from clause 17(3), the expression 1013.10, and substituting the expression 669.40 ; and

    • (e) omitting from clause 17(4), the expression 202.62, and substituting the expression 133.88 ; and

    • (f) omitting from clause 18(1), the expression 202.62, and substituting the expression 133.88 ; and

    • (g) revoking clause 19; and

    • (h) omitting from clause 20, the words clauses 17, 18, or 19 of this Part, and substituting the words clauses 17 or 18 of this Part or in the Schedule of the Freshwater Fish Farming Regulations 1983 ; and

    • (i) omitting from clause 20, the expression $202.62, and substituting the expression $133.88.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend Schedule 2 of the Fisheries (Commercial Fishing) Regulations 2001 ( the principal regulations) as follows:

  • the rate per hour, or part hour, for the issue of a special permit (for each hour taken to process the application) under section 97 of the Fisheries Act 1996 (the 1996 Act) is increased from $89.96 to $133.88:

  • the rate per hour, or part hour, for the amendment or alteration to conditions of a special permit at the request of the permit holder (for each hour taken to process the application) under section 97 of the 1996 Act is increased from $89.96 to $133.88:

  • the fee payable for an application for a marine farming permit under section 67J of the Fisheries Act 1983 (the 1983 Act) is reduced from $3,039.30 to $2,008.20:

  • the fee payable for an application for a spat catching permit under section 67Q of the 1983 Act is reduced from $3,039.30 to $2,008.20:

  • the fee payable for an application by the holder of a marine farming permit or a spat catching permit for a change to the conditions of that permit under section 67K of the 1983 Act is reduced from $1,013.10 to $669.40:

  • the fee payable for the notification under section 67M of the 1983 Act of a transfer of an interest in a marine farming permit is reduced from $202.62 to $133.88:

  • the fee payable to inspect the register of marine farming permits that is kept under section 67J(12) of the 1983 Act is reduced from $202.62 to $133.88:

  • the rate per hour, or part hour, for processing an application or a matter (in respect of which a fee is prescribed in clauses 17 or 18 of Schedule 2 of the principal regulations) is reduced from $202.62 to $133.88:

  • clause 19 of Schedule 2 of the principal regulations (which sets out the application fees for freshwater fish farming licences) is revoked because it is a duplication of the fees as set out in the Freshwater Fish Farming Regulations 1983 (as amended by the Freshwater Fish Farming Amendment Regulations 2004).
