Maori Fisheries (Appointed Day) Order 2004


Note

This order is administered in the Ministry of Fisheries.


Pursuant to section 5 of the Maori Fisheries Act 2004, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, and on the recommendation of the Minister of Fisheries, at the request of the Treaty of Waitangi Fisheries Commission, makes the following order.

1 Title
  • This order is the Maori Fisheries (Appointed Day) Order 2004.

2 Commencement
  • This order comes into force on the day after the date of its notification in the Gazette.

3 Appointed day

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order fixes 29 November 2004 as the appointed day for the purposes of the Maori Fisheries Act 2004. That Act requires the appointed day to be not later than 45 working days after the commencement of that Act (26 September 2004).

The appointed day is specified as fixing the timing for matters including the following:

  • before the appointed day, Te Ohu Kai Moana and Aotearoa Fisheries Limited must be established; and

  • on the appointed day,—

    • the existing undertaking of the Treaty of Waitangi Fisheries Commission vests in Te Ohu Kai Moana Trustee Limited, except to the extent that the undertaking is already vested in Aotearoa Fisheries Limited; and

    • the Treaty of Waitangi Fisheries Commission is dissolved; and

    • the Maori Fisheries Act 1989 is repealed; and

  • not later than 60 working days after the appointed day, Te Ohu Kai Moana Trustee Limited must establish Te Putea Whakatupu Trust and Te Wai Maori Trust.
