Commodity Levies (Green-lipped Mussels) Amendment Order 2004

  • Preamble

    At Wellington this 13th day of December 2004

Pursuant to section 4 of the Commodity Levies Act 1990 (as applied by section 305 of the Fisheries Act 1996), Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Fisheries, makes the following order.

1 Title
  • (1) This order is the Commodity Levies (Green-lipped Mussels Amendment Order 2004.

    (2) In this order, the Commodity. Levies (Green-lipped Mussels) Order 20011 is called the principal order.

2 Commencement
  • This order comes into force on 14 January 2005.

3 Interpretation
  • (1) Clause 3 of the principal order is amended by revoking the definition of packing house licensee.

    (2) Clause 3 of the principal order is amended by inserting, in its appropriate alphabetical order, the following definition:

    licensed fish receiver has the same meaning as in regulation 2 of the Fisheries (Licensed Fish Receivers) Regulations 1997.

4 Fish packing house licensees must pay levy
  • (1) The heading to clause 6 of the principal order is amended by omitting the words Fish packing house licensees and substituting the words Licensed fish receivers.

    (2) Clause 6 of the principal order is amended by omitting the words packing house licensee in both places where they appear, and substituting in each case the words licensed fish receiver.

    (3) Clause 6(1) of the principal order is amended by omitting the word section, and substituting the word clause.

5 Clauses 8, 12, 13, and 18 of the principal order consequentially amended
  • (1) Clauses 8, 13, and 18 of the principal order are amended by omitting the words packing house licensee wherever they appear, and substituting in each case the words licensed fish receiver.

    (2) Clause 12 of the principal order is amended by omitting the words packing house licensees, and substituting the words licensed fish receivers.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order amends the Commodity Levies (Green-lipped Mussels) Order 2001. It comes into force on 14 January 2005.

The amendments replace the term packing house licensee with the term licensed fish receiver, required as a consequence of the repeal of parts of the Meat Act 1981.
