These regulations are administered in the Ministry of Transport.
Pursuant to section 218 of the Land Transport Act 1998, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
(1) These regulations are the Heavy Motor Vehicle Amendment Regulations (No 3) 2004.
(2) In these regulations, the Heavy Motor Vehicle Regulations 19741 are called “the principal regulations”
.
(1) Regulation 8(b) comes into force on 1 April 2005.
(2) The rest of these regulations come into force on 27 February 2005.
Regulation 2 of the principal regulations is amended by revoking the definitions of axle set, longitudinal walking beam, metal tyre, oscillating axle, pneumatic tyre, single-tyred axle, single axle set, single large-tyred axle, single standard-tyred axle, solid tyre, tandem axle set, tri-axle set, twin-tyred axle, and twin steer set.
(1) Regulation 3(11) of the principal regulations is amended by—
(a) omitting the words “regulation 4 of these regulations”
, and substituting the expression “Land Transport Rule: Traffic Control Devices 2004 (54002)”
; and
(b) omitting the words “that regulation”
, and substituting the words “that rule”
.
(2) Regulation 3(14)(c) of the principal regulations is amended by omitting the words “regulation 4 of these regulations”
, and substituting the expression “Land Transport Rule: Traffic Control Devices 2004 (54002)”
.
(3) Regulation 3(18)(b)(ii) of the principal regulations is amended by omitting the words “regulation 4 of these regulations”
, and substituting the expression “Land Transport Rule: Traffic Control Devices 2004 (54002)”

Regulation 10(6) of the principal regulations is amended by omitting the words “A sign of the type specified in diagram No. 3 in Schedule 4 to these regulations may be used if appropriate.”
(1) Regulation 11(5) of the principal regulations is amended by omitting the words “of diagram No. 4 in Schedule 4 to these regulations”
, and substituting the words “prescribed by Land Transport Rule: Traffic Control Devices 2004 (54002)”
.
(2) Regulation 11(8) of the principal regulations is amended by omitting the words “the provisions of subclauses (5) and (6), or, as the case may require, subclause (7), of this regulation have”
, and substituting the words “subclause (5) or subclause (7) has”

(1) Regulation 12(4) of the principal regulations is amended by omitting the words “subclause (3) of this regulation”
, and substituting the expression “Land Transport Rule: Traffic Control Devices 2004 (54002)”

(2) Regulation 12(5) of the principal regulations is amended by omitting the words “subclause (3) of this regulation”

The principal regulations are amended by revoking the following:
(b) regulations 14 and 16A(1)(a), and (c) to (e), (3), and (6)(d)(i) to (iv); and
(c) Schedule 4.

This note is not part of the regulations, but is intended to indicate their general effect.
These regulations amend the Heavy Motor Vehicle Regulations 1974. Regulation 8(b) comes into force on 1 April 2005. The rest of these regulations come into force on 27 February 2005. The amendments revoke the regulations that the Land Transport (Road User) Rule 2004 and the following Land Transport Rules have replaced:
•Heavy Vehicles 2004 (31002):
•Traffic Control Devices 2004 (54002).
