5 Summary offences and penalties

• (1) The principal regulations are amended by revoking regulation 3(2)(a), and substituting the following paragraph:

  • “(a) in the case of an individual,—

    • “(i) to a fine not exceeding the amount specified in relation to that offence in the third column of Schedule 1; or

    • “(ii) to a fine of the amount determined by the relevant scale set out in Schedule 1A (as referenced in the third column of Schedule 1):”.

  (2) The principal regulations are amended by revoking regulation 3(2)(b), and substituting the following paragraph:

  • “(b) in the case of a body corporate,—

    • “(i) to a fine not exceeding the amount specified in relation to that offence in the fourth column of Schedule 1; or

    • “(ii) to a fine of the amount determined by the relevant scale set out in Schedule 1A (as referenced in the fourth column of Schedule 1).”

  (3) Regulation 3(3) of the principal regulations is revoked.

  (4) Regulation 3(4) of the principal regulations is amended by omitting the words “3 of Schedule 2 of the Transport Act 1962”, and substituting the words “3 of Schedule 1B”.
