Marriage (Forms) Amendment Regulations 2005


Note

These regulations are administered in the Department of Internal Affairs.


Pursuant to section 64 of the Marriage Act 1955, section 88 of the Births, Deaths, and Marriages Registration Act 1995, and section 35 of the Civil Union Act 2004, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • (1) These regulations are the Marriage (Forms) Amendment Regulations 2005.

    (2) In these regulations, the Marriage (Forms) Regulations 19951 are called the principal regulations.

2 Commencement
  • These regulations come into force on 26 April 2005.

3 Forms
  • (1) Regulation 3(a) of the principal regulations is amended by omitting the word paragraph (b), and substituting the words paragraphs (ab) and (b).

    (2) Regulation 3 of the principal regulations is amended by inserting, after paragraph (a), the following paragraph:

    • (ab) for a notice of intended marriage under section 23(1) of the Act where the parties are currently in a civil union with each other and wish to change the form of their relationship into marriage under section 18 of the Civil Union Act 2004, form 1A:.

    (3) Regulation 3 of the principal regulations is amended by revoking paragraph (d), and substituting the following paragraphs:

    • (d) subject to paragraph (da), for a form to be issued under section 24(1)(b) of the Act by a Registrar for the purpose of returning (under section 56(1)(a) of the Births, Deaths, and Marriages Registration Act 1995) information relating to marriages solemnised by marriage celebrants, exempt religious bodies, or under section 32 of the Act, form 4:

    • (da) for a form to be issued under section 24(1)(b) of the Act by a Registrar for the purpose of returning (under section 56(1)(a) of the Births, Deaths, and Marriages Registration Act 1995) information relating to marriages solemnised by marriage celebrants, exempt religious bodies, or under section 32 of the Act, which are a change in the form of relationship from civil union, form 4A:.

4 New forms 1, 1A, 2, 4, 4A, 5, 7, and 9 substituted in Schedule
  • The Schedule of the principal regulations is amended by revoking forms 1, 2, 4, 5, 7, and 9, and substituting forms 1, 1A, 2, 4, 4A, 5, 7, and 9 in the Schedule of these regulations in their appropriate numerical order.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 26 April 2005, amend the Marriage (Forms) Regulations 1995 to take into account the Civil Union Act 2004.

A number of forms are updated and the following new forms are inserted:

  • notice of intended marriage: change of relationship from civil union; and

  • copy of particulars of marriage: change of relationship from civil union.
