Civil Aviation (Safety) Levies Amendment Order 2005


Note

This order is administered in the Ministry of Transport.


Pursuant to section 42A of the Civil Aviation Act 1990, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title
2 Commencement
  • This order comes into force on 1 October 2005.

3 Interpretation
  • Clause 3(1) of the principal order is amended by inserting, in its appropriate alphabetical order, the following definition:

    international operator

    • (a) means a person who—

      • (i) is the holder of an aviation document issued under the Act; and

      • (ii) operates an aircraft in respect of journeys—

        • (A) beginning in New Zealand and ending outside New Zealand; or

        • (B) beginning outside New Zealand and ending in New Zealand; or

        • (C) beginning and ending outside New Zealand with an intermediate stop in New Zealand; or

        • (D) beginning and ending in New Zealand with an intermediate stop outside New Zealand; and

    • (b) includes any person who as owner or hirer is making use of the aircraft described in paragraph (a), either personally or through servants or agents, in respect of those operations.

4 Aerodrome operators must pay departing international passenger levy
  • (1) The heading to clause 9 of the principal order is amended by omitting the words Aerodrome operators, and substituting the words International operators.

    (2) The principal order is amended by revoking clause 9(1), and substituting the following subclause:

    • (1) An international operator must pay to the Authority a levy calculated at the rate of $1.00 for each international civil air passenger departing from New Zealand on an aircraft operated by that operator.

    (3) Clause 9 of the principal order is amended by omitting the words aerodrome operator in each place where they appear, and substituting in each case the words international operator.

    (4) Clause 9(2)(e)(i) of the principal order is amended by omitting the words the aerodrome, and substituting the words an aerodrome.

    (5) Clause 9(6) of the principal order is amended by omitting the words the aerodrome, and substituting the words New Zealand.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 October 2005, amends the Civil Aviation (Safety) Levies Order 2002.

The amendment—

  • provides that international operators must pay the departing international passenger levy:

  • inserts the definition of international operator.
