These regulations are administered in the Ministry of Health.


Pursuant to section 7A(6) of the Biosecurity Act 1993, Her Excellency the Governor-General, acting on the recommendation of the Minister for Biosecurity, and on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • These regulations are the Biosecurity (Resource Management Act Exemption) Regulations 2005.

2 Commencement
  • These regulations come into force on 15 December 2005.

3 Expiry
  • These regulations, unless sooner revoked, continue in force until the close of 15 December 2007, and then expire and are deemed to be revoked.

4 Eradication actions, exemption, and Kaipara area defined
  • In these regulations,—

    eradication actions means actions taken in accordance with Part 6 of the Biosecurity Act 1993 in an attempt to eradicate Ochlerotatus camptorhynchus from the Kaipara area

    exemption means the exemption that—

    • (b) expired on 15 December 2005; and

    Kaipara area includes the areas of Mangawhai, Whangaparaoa, and Whitford.

5 Continuation of exemption
  • The exemption is continued.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 15 December 2005, relate to actions taken under Part 6 of the Biosecurity Act 1993 in an attempt to eradicate the southern saltmarsh mosquito (Ochlerotatus camptorhynchus) from the Kaipara area (which includes the areas of Mangawhai, Whangaparaoa, and Whitford).

Those actions were exempted from the provisions of Part 3 of the Resource Management Act 1991 under an exemption granted under section 7A(1) of the Biosecurity Act 1993 on 17 November 2005.

The exemption expired on 15 December 2005. These regulations continue the exemption.

These regulations will, unless sooner revoked, continue in force until the close of 15 December 2007.
