Medicines Amendment Regulations 2006


Note

These regulations are administered by the Ministry of Health.


  • Preamble

    At Wellington this 19th day of June 2006

Pursuant to section 105 of the Medicines Act 1981, Her Excellency the Administrator of the Government, acting on the advice of the Minister of Health tendered after consultation with the organisations or bodies appearing to the Minister to be representative of persons likely to be substantially affected, and acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • These regulations are the Medicines Amendment Regulations 2006.

2 Commencement
  • These regulations come into force on 24 July 2006.

3 Principal regulations amended
4 Labelling of medicines
  • Regulation 13(1) is amended by revoking paragraphs (f) to (h) and substituting the following paragraphs:

    • (f) in the case of a prescription medicine,—

      • (i) the words PRESCRIPTION MEDICINE or words of a similar meaning; or

      • (ii) the words PRESCRIPTION ONLY MEDICINE or words of a similar meaning; or

      • (iii) the acronym POM:

    • (g) in the case of a restricted medicine,—

      • (i) the words RESTRICTED MEDICINE; or

      • (ii) the words PHARMACIST ONLY MEDICINE:

    • (h) in the case of a pharmacy-only medicine,—

      • (i) the words PHARMACY-ONLY MEDICINE or words of a similar meaning; or

      • (ii) the words PHARMACY MEDICINE or words of a similar meaning:

5 Warning statements for certain medicines related products, and cosmetics
  • Regulation 22 is amended by revoking subclause (5) and substituting the following subclause:

    • (5) Every container of a restricted medicine or pharmacy-only medicine and that contains hydrocortisone or hydrocortisone acetate must, subject to regulation 23, bear, in addition to any other statement that is required by these regulations, the warning statement If ailment does not respond to treatment within 7 days, seek medical attention, or words of similar meaning.

6 Containers for medicines, related products, and cosmetics
  • Regulation 35 is amended by revoking subclauses (1) and (2) and substituting the following subclause:

    • (1) A person must not pack, store, or sell a prescription medicine, restricted medicine, or pharmacy-only medicine in a container made of paper; but nothing in this subclause prevents the person from packing, storing, or selling the medicine in a container made of cardboard.

7 New Schedule 1 substituted
  • Schedule 1 is revoked and the Schedule 1 set out in the Schedule of these regulations is substituted.

8 Consequential revocation
  • The Medicines Amendment Regulations 2002 (SR 2002/134) are consequentially revoked.

Schedule 1
Prescription, restricted, and pharmacy-only medicines

Every reference to a medicine in this schedule applies whether the medicine is synthetic in origin or is from biological or mineral sources.

Unless specific reference is made otherwise, every reference applies also to medicines that are—

  • (a) preparations and admixtures containing any proportion of any substance listed in this schedule:

  • (b) salts and esters of any substance listed in this schedule:

  • (c) preparations or extracts of biological materials listed in this schedule:

  • (d) salts or oxides of elements listed in this schedule.

Unless specific reference is made otherwise, every reference to a medicine in this schedule applies,—

  • (a) if the medicine is an injection or eye preparation, to any concentration of the medicine; and

  • (b) if the medicine is not an injection or eye preparation, only if the concentration of the medicine is greater than 10 milligrams per litre or per kilogram.

Where any reference is modified by a statement of the strength of the medicine, the strength is calculated using the free acid, base, alcohol, or element unless specifically stated otherwise.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 24 July 2006, replace Schedule 1 of the Medicines Regulations 1984, and correct some references to medicines in those regulations.

Classification of medicines under Schedule 1

Schedule 1 relates to the classification of medicines for the purposes of the Medicines Act 1981 (the Act). Schedule 1 has 3 Parts:

  • Part 1---prescription medicines (which, in general terms, may be supplied only under a prescription given by a medical practitioner, dentist, registered midwife, veterinarian, or designated prescriber---the prescription medicines that designated prescribers may be authorised to prescribe are specified by regulations under section 105(1)(q) of the Act); and

  • Part 2---restricted medicines (which, in general terms, may be supplied without a prescription, but only by a registered pharmacist in a pharmacy or a hospital, and with certain details of the supply being recorded); and

  • Part 3-pharmacy-only medicines (which, in general terms, may be supplied without a prescription, by a registered pharmacist or by another person, at a pharmacy or a hospital, or at a shop in an isolated area that is licensed to sell the medicine).

Minister may (re)classify medicines by notices in the Gazette

Medicines may also be quickly (if temporarily) (re)classified for the purposes of the Act by Gazette notices issued by (or on behalf of) the Minister of Health under section 106 of the Act.

The notices do not amend Schedule 1, but Schedule 1 ceases to have effect to the extent that it is inconsistent with them.

The notices are temporary because they cease to have effect 6 months after the date on which they come into force. However, (re)classifications made by a Gazette notice are usually continued (through later Gazette notices) until they can be recognised permanently through amendments to Schedule 1.

New Schedule 1 recognises (re)classifications by Gazette notices

To the extent that it does not cease to have effect because of later Gazette notices, new Schedule 1 recognises, permanently, temporary (re)classifications of medicines done by Gazette notices issued since Schedule 1 was last replaced on 30 June 2002. For the details of those (re)classifications, see the notice of 2 February 2006 (which contains and continues all changes before that date) and the notice of 9 March 2006 (which contains the latest changes).

Correction of references to medicines

The other amendments are to ensure that all prescription medicines are treated alike, all restricted medicines are treated alike, and all pharmacy-only medicines are treated alike, regardless of whether they are such medicines because they are listed in Schedule 1 or because of a Gazette notice under section 106 of the Act. This purpose is achieved by changing references to medicines specified in Schedule 1 to references to prescription medicines, restricted medicines, and pharmacy-only medicines, as appropriate (see regulations 4 to 6).
