This notice is administered by the Ministry of Fisheries.


Pursuant to section 186A of the Fisheries Act 1996, the Minister of Fisheries gives the following notice.

1 Title
  • This notice is the Fisheries (Mount Maunganui Temporary Closure–Green-lipped Mussels) Notice 2006.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Expiry
  • This notice expires 15 months after its commencement.

4 Area closed for taking of green-lipped mussels
  • (1) No person may take any green-lipped mussel from the Mount Maunganui closure area.

    (2) In this clause, Mount Maunganui closure area means that area of New Zealand fisheries waters lying within an area bounded by a line that—

    • (a) commences at a point at mean high-water mark that is an extension of the centre line of Pacific Avenue, Mount Maunganui (at 37°38.11′S and 176°11.02′E); then

    • (b) proceeds by a straight line to the southernmost point of Moturiki Island (at 37°38.08′S and 176°11.02′E); then

    • (c) proceeds along the mean high-water mark on the eastern side of Moturiki Island to the northernmost point of that island (at 37°37.85′S and 176°11.15′E); then

    • (d) proceeds by a straight line in a northerly direction to a point at 37°37.74′S and 176°11.15′E; then

    • (e) proceeds by a straight line in an easterly direction to a point at 37°37.74′S and 176°11.62′E; then

    • (f) proceeds in a southerly direction to the northernmost point of Motuotau Island (at 37°37.91′S and 176°11.62′E); then

    • (g) proceeds along the mean high-water mark on the eastern side of Motuotau Island to the southernmost point of that island (at 37°38.04′S and 176°11.62′E); then

    • (h) proceeds by a straight line to a point at mean high-water mark that is an extension of the centre line of Banks Avenue (at 37°38.30′S and 176°11.26′E); then—

    • (i) proceeds in a generally north-westerly direction along the mean high-water mark to the point of commencement.

5 Revocation
  • The Fisheries (Mount Maunganui Temporary Closure–Green-lipped Mussels) Notice 2004 (SR 2004/204) is revoked.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice prohibits the taking of green-lipped mussels from the Mount Maunganui area. The notice comes into force on the day after its notification in the Gazette and expires 15 months later.

The notice also revokes the Fisheries (Mount Maunganui Temporary Closure—Green-lipped Mussels) Notice 2004, which expired on the close of 5 July 2006.
