Biosecurity (Forms) Amendment Regulations 2006

  • Preamble

    At Wellington this 28th day of August 2006

Pursuant to section 165(1)(x) of the Biosecurity Act 1993, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • These regulations are the Biosecurity (Forms) Amendment Regulations 2006.

2 Commencement
  • These regulations come into force on 10 October 2006.

4 Schedule amended
  • (1) Form C of the Schedule is amended by—

    • (a) omitting (WHO IS REFERRED TO AS 'THE DEFENDANT'); and

    • (b) omitting OF THE DEFENDANT; and

    • (c) omitting Name: and substituting Full name:; and

    • (d) omitting Address: and substituting Full address:; and

    • (e) omitting defendant from paragraphs 1 and 2 under the heading Nature of Offence and substituting in each case person; and

    • (f) omitting address from paragraph 4(d) of the notes and substituting full address.

    (2) Form E of the Schedule is amended by—

    • (a) omitting (WHO IS REFERRED TO AS 'THE DEFENDANT'); and

    • (b) omitting OF THE DEFENDANT ; and

    • (c) omitting Name: and substituting Full name: ; and

    • (d) omitting Address: and substituting Full address:; and

    • (e) omitting defendant in each place where it appears in the paragraph under the heading Nature of offence and substituting in each case person; and

    • (f) omitting To be completed only on copy to be filed in court and substituting To be provided for filing in court; and

    • (g) omitting Registered or ordinary post and substituting Postal service; and

    • (h) omitting Served by On [Date] and substituting Served by [full name] at [full address of service] on [date of service]; and

    • (i) omitting address from paragraph 4(d) of the notes and substituting full address.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations amend the Biosecurity (Forms) Regulations 1995. The amendments are required to reflect changes (made by the Summary Proceedings Amendment Act 2006) to the summary procedure for infringement offences in section 21 of the Summary Proceedings Act 1957.

The regulations come into force on 10 October 2006.
