Fisheries (Schedule 6) Order 2006


This order is administered by the Ministry of Fisheries.

  • Preamble

    At Wellington this 28th day of August 2006

Pursuant to section 72(7) of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title
  • This order is the Fisheries (Schedule 6) Order 2006.

2 Commencement
  • This order comes into force on 1 October 2006.

3 Schedule 6 of Fisheries Act 1996 amended
  • Schedule 6 of the Fisheries Act 1996 is amended by inserting the item set out in the Schedule of this order in its appropriate alphabetical order.

Amendment to Schedule 6 of Fisheries Act 1996

Knobbed whelk(Austrofusus glans)Quota management areas KWH1, KWH2, KWH3, KWH4, KWH5, KWH6, KWH7A, KWH7B, KWH8, and KWH9A commercial fisher may return any knobbed whelk to the waters from which it was taken if—
  (a)the knobbed whelk is likely to survive on return; and
  (b)the return takes place as soon as practicable after the knobbed whelk is taken.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which takes effect on 1 October 2006, inserts knobbed whelk into Schedule 6 of the Fisheries Act 1996 as stocks that may be returned to the sea in accordance with certain requirements.
