  • Preamble

    At Wellington this 2nd day of October 2006

Pursuant to section 30D of the State Sector Act 1988, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title
  • This order is the State Sector (Employees of Boards of Waihopai School and Ruru Special School) Order 2006.

2 Commencement
  • This order comes into force on 6 October 2006.

3 Sections 30E and 30F of State Sector Act 1988 to apply to transfer of certain specialist and therapy functions from Boards of Trustees of Waihopai School and Ruru Special School to Ministry of Education
  • Sections 30E and 30F of the State Sector Act 1988 apply to—

    • (a) the transfer from the Board of Trustees of Waihopai School to the Ministry of Education of the function of delivering specialist and therapy services for education centres, and primary, composite, and secondary schools, in the Ministry's Southland special education district; and

    • (b) the transfer from the Board of Trustees of Ruru Special School to the Ministry of Education of the function of delivering specialist and therapy services for education centres, and primary, composite, and secondary schools, in the Ministry's Southland special education district.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 6 October 2006, applies sections 30E and 30F of the State Sector Act 1988 to employees of the Boards of Trustees of Waihopai School and Ruru Special School who will be affected by the transfer from those boards to the Ministry of Education of the function of delivering specialist and therapy services for primary schools, composite and secondary schools, and education centres in the Ministry's Southland special education district.

Section 30E restricts compensation for technical redundancy. Its application has the effect that an employee who is offered equivalent employment with the Ministry of Education (or accepts other employment with the Ministry) is not entitled to compensation for the technical redundancy caused by the transfer of the service delivery function to the Ministry.

Section 30F excludes some provisions of the State Sector Act 1988 that usually apply to making appointments to positions in departments of State. Its application has the effect that the Ministry of Education does not have to comply with some standard obligations if it employs people formerly employed to deliver specialist or therapy services at Waihopai School or Ruru Special School (for example, the obligation to notify a vacant position before appointing a person to it).
