  • Preamble

    At Wellington this 26th day of February 2007

Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • These regulations are the Fisheries (Auckland and Kermadec Areas Amateur Fishing) Amendment Regulations 2007.

2 Commencement
  • These regulations come into force on 1 April 2007.

3 Principal regulations amended
4 New regulation 3D inserted
  • The following regulation is inserted after regulation 3C:

    3D Minimum size for blue cod
    • Despite regulation 6 of the Fisheries (Amateur Fishing) Regulations 1986, no person may take or possess any blue cod taken from the Auckland Fishery Management Area that is less than 30 cm in length.

5 New regulation 8 inserted
  • The following regulation is inserted after regulation 7:

    8 Seasonal restrictions on taking of scallops
    • Despite regulation 24 of the Fisheries (Amateur Fishing) Regulations 1986, no person may take or possess scallops taken from the Auckland Fishery Management Area (East) between 1 April and 31 August in the same year (both days inclusive).

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 April 2007, amend the Fisheries (Auckland and Kermadec Areas Amateur Fishing) Regulations 1986.

The effect of the amendments is as follows:

  • the minimum legal size for blue cod is reduced from 33 cm to 30 cm in the Auckland Fishery Management Area:

  • the closed scallop season for the Auckland Fisheries Management Area (East) is shifted to 1 April to 31 August (inclusive). The closed scallop season for other areas remains unchanged (15 February to 14 July (inclusive)).
