  • Preamble

    At Wellington this 5th day of March 2007

Pursuant to sections 74C and 75C of the War Pensions Act 1954, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title
  • This order is the War Pensions (Rates of Pensions, Lump Sum Payments, and Allowances) Order 2007.

2 Commencement
  • (1) This order (except clause 4 and Schedule 2) comes into force at the beginning of 1 April 2007.

    (2) Clause 4 and Schedule 2 come into force immediately after the commencement of the rest of this order.

3 Increasing rates of pensions, lump sum payments, and allowances to reflect changes in CPI
  • (1) Each provision of the War Pensions Act 1954 listed in column 1 of Schedule 1 of this order is amended by omitting the expression set out opposite to it in column 2 in each place where that expression appears and substituting in each case the expression set out opposite to it in column 3.

    (2) The amendments made by subclause (1) to Schedule 12 of the War Pensions Act 1954 apply in respect of persons who die on or after 1 April 2007.

4 Further increases to certain amounts
  • (1) The amounts set out in clauses 1(a) to (c) and 2(a) and (b) of Schedule 11 of the War Pensions Act 1954 (as substituted by clause 3 and Schedule 1 of this order) are further increased in the manner provided in subclause (2) of this clause.

    (2) Each provision of Schedule 11 of the War Pensions Act 1954 listed in column 1 of Schedule 2 of this order is amended by omitting the expression set out opposite to it in column 2 in each place where that expression appears and substituting in each case the expression set out opposite to it in column 3.

5 Revocation
  • The War Pensions (Rates of Pensions, Lump Sum Payments, and Allowances) Order 2006 (SR 2006/43) is revoked.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 April 2007, amends the War Pensions Act 1954 in 2 ways.

First, it increases the following war pensions, lump sum payments, and allowances in accordance with an increase of 2.63% in the All Groups Consumers Price Index (CPI):

  • the maximum rate of a disablement pension:

  • the maximum rate of an additional pension for severe disablement:

  • clothing allowances:

  • the maximum rate of allowance for the services of attendants for disabled pensioners:

  • the maximum rate of surviving spouses' or surviving partners' pensions:

  • the maximum rate of additional parents' allowances payable to a surviving spouse or surviving partner:

  • the maximum rate of children's pensions in ordinary cases:

  • the maximum rate of war orphans' pensions:

  • the maximum rates of veterans' pensions:

  • the maximum payments on death of a veteran or a veteran's spouse or civil union partner.

Clause 3 and Schedule 1 increase the rates of veterans' pensions both to reflect changes in the CPI and to meet the requirements in section 74C of the War Pensions Act 1954 (which relates to the annual adjustment of the rates of veterans' pensions).

Secondly, the order (in clause 4 and Schedule 2) makes some additional increases to figures already increased by clause 3 and Schedule 1, to implement the Government's commitments in relation to the level of veterans' pensions.
