Submarine Cables and Pipelines Protection (Tui Area Development) Order 2007

4 Protected area

• (1) The area described in the Schedule is a protected area for the purposes of the Submarine Cables and Pipelines Protection Act 1996 in respect of all ships.

  (2) Subclause (1) does not apply to a ship that is being used—

  • (a) for research carried out by or for the Ministry of Fisheries, as long as the research is carried out without directly or indirectly attaching any of the ship to the seabed, whether by anchoring or any other means; or

  • (b) as a floating production, storage, and offloading installation anchored at or near position 39°25′39.80″S 173°14′12.40″E; or

  • (c) to construct, repair, maintain, or service—

    • (i) a floating production, storage, and offloading installation that is anchored, or a fixed platform that is located, at or near position 39°25′39.80″S 173°14′12.40″E; or

    • (ii) wellheads or submarine pipelines connected, or to be connected, to that installation or platform; or

    • (iii) facilities associated with that installation or platform, or those wellheads or pipelines.
