This order is administered by the Ministry of Transport.
Pursuant to section 12(1) of the Submarine Cables and Pipelines Protection Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Transport, makes the following order.
4 Protected area
This order is the Submarine Cables and Pipelines Protection (Tui Area Development) Order 2007.
This order comes into force on 30 August 2007.
Positions stated in this order are expressed in terms of the coordinates used in the World Geodetic System 1984.
(1) The area described in the Schedule is a protected area for the purposes of the Submarine Cables and Pipelines Protection Act 1996 in respect of all ships.
(2) Subclause (1) does not apply to a ship that is being used—
(a) for research carried out by or for the Ministry of Fisheries, as long as the research is carried out without directly or indirectly attaching any of the ship to the seabed, whether by anchoring or any other means; or
(b) as a floating production, storage, and offloading installation anchored at or near position 39°25′39.80″S 173°14′12.40″E; or
(c) to construct, repair, maintain, or service—
(i) a floating production, storage, and offloading installation that is anchored, or a fixed platform that is located, at or near position 39°25′39.80″S 173°14′12.40″E; or
(ii) wellheads or submarine pipelines connected, or to be connected, to that installation or platform; or
(iii) facilities associated with that installation or platform, or those wellheads or pipelines.
Schedule: replaced, on 9 January 2015, by clause 4 of the Submarine Cables and Pipelines Protection (Tui Area Development) Amendment Order 2014 (LI 2014/379).
The area bounded as follows:
(a) by straight lines—
(i) commencing at position 39°22′46.61″S 173°12′45.74″E; then
(ii) to position 39°24′49.80″S 173°14′36.92″E; then
(iii) to position 39°25′48.35″S 173°15′16.02″E; then
(iv) to position 39°25′50.75″S 173°15′17.56″E; then
(v) to position 39°25′53.21″S 173°15′18.70″E; then
(vi) to position 39°25′55.82″S 173°15′19.57″E; then
(vii) to position 39°25′58.48″S 173°15′19.88″E; then
(viii) to position 39°26′01.15″S 173°15′19.61″E; then
(ix) to position 39°26′03.74″S 173°15′18.78″E; then
(x) to position 39°26′07.51″S 173°15′16.38″E; then
(xi) to position 39°26′16.38″S 173°15′08.43″E; then
(xii) to position 39°26′46.83″S 173°14′25.45″E; then
(b) by the arc of a circle of 500 metres radius centred in position 39°26′35.10″S 173°14′11.02″E to position 39°26′47.33″S 173°13′57.29″E; then
(c) by straight lines—
(i) to position 39°26′13.76″S 173°13′13.97″E; then
(ii) to position 39°25′35.72″S 173°12′30.53″E; then
(d) by the arc of a circle of 500 metres radius centred in position 39°25′23.74″S 173°12′44.61″E to position 39°25′27.95″S 173°12′24.42″E; then
(e) by a straight line to position 39°22′36.85″S 173°11′25.20″E; then
(f) by the arc of a circle of 500 metres radius centred in position 39°22′32.65″S 173°11′45.37″E to position 39°22′19.53″S 173°11′57.64″E; then
(g) by a straight line to the position of commencement referred to in paragraph (a)(i).
