Fisheries (South-East Area Commercial Fishing) Amendment Regulations 2007

  • Preamble

    At Wellington this 27th day of August 2007

Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • These regulations are the Fisheries (South-East Area Commercial Fishing) Amendment Regulations 2007.

2 Commencement
  • These regulations come into force on 1 October 2007.

3 Principal regulations amended
  • These regulations amend the Fisheries (South-East Area Commercial Fishing) Regulations 1986.

4 New regulation 3F inserted
  • The following regulation is inserted after regulation 3E:

    3F Unattended set nets in East Otago taiapure
    • (1) A commercial fisher who uses a set net in East Otago taiapure must, at all times, remain in the immediate vicinity of the set net.

      (2) In this regulation, East Otago taiapure means the area described in the Schedule to the Fisheries (East Otago Taiapure) Order 1999.

5 Trawling prohibited in certain seamount areas
  • Regulation 4C(2)(d) is revoked and the following paragraph substituted:

    • (d) the area located in fisheries management area 4 that is bounded by—

      • (i) the latitudes 44°11'S and 44°07'S; and

      • (ii) the longitudes 174°48'W and 174°39'W:.

6 Offences
  • Regulation 12(1) is amended by inserting 3F, after 3E,.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 October 2007, amend the Fisheries (South-East Area Commercial Fishing) Regulations 1986, by—

  • inserting new regulation 3F, which provides that a commercial fisher who uses a set net in the area of East Otago taiapure must, at all times, remain in the immediate vicinity of the set net. Regulation 12 is consequentially amended to provide that a commercial fisher who contravenes or fails to comply with the new requirement commits an offence and is liable on summary conviction to a fine not exceeding $20,000:

  • changing co-ordinates in regulation 4C(2)(d) (which relates to the prohibition on trawling in fisheries management area 4).
