Fisheries (Commercial Fishing) Amendment Regulations (No 2) 2007

  • Preamble

    At Wellington this 27th day of August 2007

Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
  • These regulations are the Fisheries (Commercial Fishing) Amendment Regulations (No 2) 2007.

2 Commencement
  • These regulations come into force on 1 October 2007.

3 Principal regulations amended
  • These regulations amend the Fisheries (Commercial Fishing) Regulations 2001.

4 Interpretation
  • Regulation 3 is amended by inserting the following definition in its appropriate alphabetical order:

    prawn killer means a shellfish of the species Ibacus alticrenatus.

5 Trawl net restrictions
  • Regulation 71(5)(a) and (b) are amended by inserting or prawn killer after scampi.

6 Schedule 2 amended
  • Clause 16(2) of Schedule 2 is revoked.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 October 2007, amend the Fisheries (Commercial Fishing) Regulations 2001 by—

  • inserting a definition of prawn killer into regulation 3 (which relates to interpretation). Prawn killer is a species of shellfish that is to be introduced into the quota management system on 1 October 2007. Regulation 71(5)(a) and (b) (which relates to trawl net restrictions) are consequentially amended to insert references to prawn killer:

  • revoking clause 16(2) of Schedule 2 (which specifies fees for the registration of automatic location communicators).
