Pursuant to section 12(1) of the Submarine Cables and Pipelines Protection Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Transport, makes the following order.

Order

1 Title
  • This order is the Submarine Cables and Pipelines Protection (Maari Development) Order 2008.

2 Commencement
  • This order comes into force on 23 February 2008.

3 Interpretation
  • Positions stated in this order are expressed in terms of the co-ordinates used in the World Geodetic System 1984.

4 Protected area
  • (1) The area described in the Schedule is a protected area for the purposes of the Submarine Cables and Pipelines Protection Act 1996 in respect of all ships.

    (2) Subclause (1) does not apply to a ship that is being used—

    • (a) for research being carried out by or for the Ministry of Fisheries, as long as the research is carried out without directly or indirectly attaching any part of the ship to the seabed, whether by anchoring or any other means; or

    • (b) as a floating production, storage, and offloading installation centred at or near position 39°58′21.8623″S 173°17′51.6630″E; or

    • (c) to undertake pipeline surveys (subject to obtaining the prior consent of the operator of the Maari Development); or

    • (d) to construct, repair, maintain, or service—

      • (i) a floating production, storage, and offloading installation that is centred at or near position 39°58′21.8623″S 173°17′51.6630″E; or

      • (ii) a wellhead platform that is centred at position 39°59′09.009″S 173°17′37.808″E; or

      • (iii) submarine cables or pipelines connected, or to be connected, to that installation or platform; or

      • (iv) facilities associated with that installation or platform or those cables or pipelines.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order comes into force on 23 February 2008. The order declares the specified area relating to the Maari Development to be a protected area for the purposes of the Submarine Cables and Pipelines Protection Act 1996. The order applies to all ships except those being used for the purposes specified in the order.
