Electronic Transactions (Amendments to Schedule) Order 2008

Pursuant to section 14 of the Electronic Transactions Act 2002, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title

  • This order is the Electronic Transactions (Amendments to Schedule) Order 2008.

2 Commencement

  • This order comes into force on 6 June 2008.

3 Schedule of Electronic Transactions Act 2002 amended

  • This order amends the Schedule of the Electronic Transactions Act 2002.

4 Amendments to Part 2 of Schedule

  • (1) Part 2 is amended by omitting the items relating to the following enactments:

    • (a) the Dental Act 1988:

    • (b) the Dieticians Act 1950:

    • (c) the Health Act 1956:

    • (d) the Human Tissue Act 1964:

    • (e) the Medical Practitioners Act 1995:

    • (f) the Mental Health (Compulsory Assessment and Treatment) Act 1992:

    • (g) the Occupational Therapy Act 1949:

    • (h) the Penal Institutions Regulations 2000:

    • (i) the Pharmacy Act 1970:

    • (j) the Physiotherapy Act 1949:

    • (k) the Tuberculosis Act 1948:

    • (l) the Venereal Diseases Regulations 1982.

    (2) Part 2 is amended by inserting the following item in its appropriate alphabetical order:

5 Amendments to Part 3 of Schedule

  • Part 3 is amended by omitting items (i), (j), and (m).

6 Amendments to Part 4 of Schedule

  • (1) Part 4 is amended by omitting item (13) and substituting the following item:

    • “(13) Motor Vehicle Disputes Tribunals established under the Motor Vehicle Sales Act 2003:”.

    (2) Part 4 is amended by omitting item (21) and substituting the following item:

    • “(21) Review Tribunals established under the Mental Health (Compulsory Assessment and Treatment) Act 1992:”.

    (3) Part 4 is amended by omitting items (22) to (28).

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 6 June 2008, amends the Schedule of the Electronic Transactions Act 2002 (the Act). The Schedule lists the enactments or provisions of enactments that are excluded from the application of Part 3 of the Act. This order removes a number of exclusions and in 3 instances adds an exclusion.
