This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 26 June 2008, substitutes a later date for the date specified in section 450(3)(b)(ii) of the Building Act 2004 (the Act). The substituted date defers for 9 months the end (if they have not ended earlier, and there is no further deferral) of the following:

  • the period, specified in section 450(3) of the Act, during which a territorial authority may act as a building consent authority (including in relation to a dam) even though the territorial authority has yet to be registered under section 191 of the Act; and

  • the duty, under section 450(3A) of the Act, of a territorial authority that is registered under section 191 of the Act to act as a building consent authority in relation to a dam within that territorial authority's district.

Issued under the authority of the Acts and Regulations Publication Act 1989.

Date of notification in Gazette: 29 May 2008.

This order is administered by the Department of Building and Housing.
