Pursuant to section 236 of the Land Transfer Act 1952 and section 26 of the Joint Family Homes Act 1964, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title
  • These regulations are the Joint Family Homes Amendment Regulations 2008.

2 Commencement
  • These regulations come into force on 29 September 2008.

3 Principal regulations amended
  • These regulations amend the Joint Family Homes Regulations 1965.

4 New regulation 5A inserted
  • The following regulation is inserted after regulation 5:

    5A Electronic lodgement of applications under section 5 or 12A of Act
    • (1) An application to the Registrar under section 5 or 12A of the Act to register land as a joint family home may be made and lodged as an electronic instrument under the Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002.

      (2) The application must be supported by a copy of—

      • (a) a statutory declaration in form 1 or 1A (as the case may require); and

      • (b) the husband or wife’s consent under section 5(1) of the Act (if applicable).

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 29 September 2008, amend the Joint Family Homes Regulations 1965 to enable an application to register land as a joint family home to be made and lodged electronically under the Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002. Section 26 of that Act enables the Registrar-General of Land to specify the acceptable forms of electronic instruments.
