Fisheries (Notification of Proposal to Establish Te Wakatehaua Taiapure-Local Fishery) Notice 2008

Pursuant to section 178(2) of the Fisheries Act 1996, the Spatial Allocations Manager of the Ministry of Fisheries, acting pursuant to a delegation from the chief executive of the Ministry of Fisheries under the State Sector Act 1988, gives the following notice.

1 Title
  • This notice is the Fisheries (Notification of Proposal to Establish Te Wakatehaua Taiapure-Local Fishery) Notice 2008.

2 Proposal to establish taiapure-local fishery at Te Wakatehaua
  • A proposal by Te Aupouri to establish a taiapure-local fishery at Te Wakatehaua (Ninety Mile Beach) has been agreed to in principle by the Minister of Fisheries after consultation with the Minister of Maori Affairs and having regard to the provisions of section 176(2) of the Fisheries Act 1996.

3 Description of area subject to proposal
  • The area subject to the proposal includes all those New Zealand fisheries waters below mean high-water springs that are enclosed by a line—

    • (a) commencing from a point near Te Aari (at 34°42.10′S and 172°54.79′E); then

    • (b) proceeding offshore in a southwesterly direction for 2.1 km to a point at 34°42.78′S and 172°53.69′E; then

    • (c) proceeding in a northwesterly direction generally parallel to the shoreline for a distance of 2.7 km, to a point at 34°41.82′S and 172°52.32′E; then

    • (d) proceeding in a northerly direction in a straight line for 1.8 km to a point at 34°40.823′S and 172°52.176′E; then

    • (e) proceeding in a northeasterly direction to a point on mean high-water springs (at 34°40.20′S and 172°53.23′E); then

    • (f) proceeding along mean high-water springs to the point of commencement.

4 Public inspection of proposal
  • (1) A copy of the proposal is available for public inspection, for a period of 2 months following the date of publication of this notice in the Gazette, at the following addresses:

    • (a) Maori Land Court, Level 2 Manaia House, Rathbone Street, Whangārei:

    • (b) Ministry of Fisheries, Braidwood House, 5 Allen Bell Drive, Kaitaia:

    • (c) Ministry of Fisheries, 32 Herekino St, Whangārei:

    • (d) Ministry of Fisheries (Head Office), ASB Bank House, 101–103 The Terrace, Wellington:

    • (e) Far North District Council, Memorial Avenue, Kaikohe:

    • (f) Northland Regional Council, 192 Commerce Street, Kaitaia.

    (2) A copy of the proposal may be obtained by telephoning the Ministry of Fisheries, Wellington, on (04) 819 2621.

5 Objections to, and submissions on, proposal
  • (1) Any affected person may lodge an objection to the proposal or a submission on it (or both).

    (2) An objection or submission must be lodged within 2 months following the date of notification of this notice in the Gazette.

    (3) The place for lodging objections and submissions is the Maori Land Court, Level 2 Manaia House, Rathbone Street, PO Box 1764, Whangārei.

    (4) Any objections or submissions must—

    • (a) identify the grounds on which they are made; and

    • (b) be supplemented by any particulars or information that the Registrar of the Maori Land Court requests for the person making the objection or submissions, being particulars or information that the Registrar considers necessary to sufficiently identify the grounds for the objection or submission.

    (5) In this clause, affected person means any person (including any public authority, local authority, Minister of the Crown, or statutory body) who—

    • (a) is or could be affected by any aspect of the proposed taiapure-local fishery; or

    • (b) has any function, power, or duty that relates to any aspect of the proposed taiapure-local fishery.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice gives notice of a proposal to establish a taiapure-local fishery at Te Wakatehaua (Ninety Mile Beach).

The proposal is available for public inspection for a period of 2 months after the date of notification of this notice in the Gazette. During that time, persons who may be affected by any aspect of the proposed taiapure-local fishery may lodge an objection or submissions with the Maori Land Court.
