Pursuant to section 38 of the Civil Aviation Act 1990, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title
  • These regulations are the Civil Aviation Charges Regulations (No 2) Amendment Regulations (No 2) 2008.

2 Commencement
  • These regulations come into force on 23 October 2008.

3 Principal regulations amended
4 Amendments to Schedule
  • (1) The Schedule is amended by omitting the section F heading and substituting the following heading:

    Section F: Air traffic services, navigation installation, and instrument flight procedure service and registration charges.

    (2) Section F of the Schedule is amended by omitting item 1 and substituting the following item:

    1 Telecommunication service certificate, air traffic service certificate, aeronautical information service certificate, and instrument flight procedure service certificate
    • A charge of $133 per person hour is payable in respect of—

      • (a) the assessment of an application; or

      • (b) the grant or renewal of, or any amendment to, a telecommunication service certificate, an air traffic service certificate, an aeronautical information service certificate, or an instrument flight procedure service certificate.

    (3) Section F of the Schedule is amended by omitting item 2 and substituting the following item:

    2 Monitoring of providers of air traffic services, navigation installations, or instrument flight procedure services
    • A charge of $133 per person hour is payable in respect of the monitoring of an air traffic services provider, an air navigation installation provider, or an instrument flight procedure service provider.

    (4) Section F of the Schedule is amended by omitting item 5 and substituting the following item:

    5 Instrument flight procedure registration
    • A charge of $133 per person hour is payable in respect of the registration of instrument flight procedures.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 23 October 2008, amend the Civil Aviation Charges Regulations (No 2) 1991. Section F of the Schedule of these regulations is amended to provide for charges in respect of the assessment of an application or for the grant or renewal of an instrument flight procedure certificate granted under Part 173 of the Civil Aviation Rules, the monitoring of instrument flight procedure service, and the registration of instrument flight procedures under Part 95 of the Civil Aviation Rules.
