Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 16 December 2008, imposes a levy on wheat grain grown commercially in New Zealand for sale or for processing into a value-added product. The levy is payable to United Wheatgrowers (NZ) Limited. Growers of wheat grain are primarily responsible for paying the levy. However, if a grower sells wheat grain or wheat grain product to a collection agent, the collection agent must pay the levy and recover it from the grower.

This order revokes and replaces the Commodity Levies (Wheat Grain) Order 2002. Section 13 of the Commodity Levies Act 1990 provides that a commodity levy, unless earlier revoked, expires 6 years after it is made.
