Copyright (New Technologies) Amendment Act 2008 Commencement Amendment Order (No 2) 2009

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on its notification in the Gazette, revokes clause 2(2) of the Copyright (New Technologies) Amendment Act 2008 Commencement Order (No 2) 2008 and substitutes a new clause 2(2).

Clause 2(1) brought most of the Copyright (New Technologies) Amendment Act 2008 into force. Subclause (2), however, originally provided that new section 92A of the Copyright Act 1994, as inserted by section 53 of the Copyright (New Technologies) Amendment Act 2008, was not to come into force until 28 February 2009. That date was subsequently amended to 27 March 2009.

A review of new section 92A of the Copyright Act 1994 is required before it comes into force to determine if it should be amended or replaced. If it is amended, a new commencement order will be made to bring the amended section into force.
