Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 June 2009, prescribe amounts for the purposes of sections 64, 64A, 65, and 77 of the Administration Act 1969. The updated amounts reflect inflationary changes since the default amounts in section 82A(2) and (3) of the Act were set in 1998.
The amount prescribed for the purposes of sections 64(1), 64A(3), and 65(2) and (5) provides the maximum value of certain individual assets that can be distributed by an executor without obtaining probate. Regulation 4 increases this amount from $11,000 to $15,000.
The amount prescribed for the purposes of section 77 is the amount from a deceased person's estate that his or her surviving spouse or partner will receive if the deceased person died intestate. Regulation 5 increases this amount from $121,500 to $155,000.
