Pursuant to section 69C(1) to (7) of the Health Act 1956, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title
  • This order is the Health (Deferral of General Application of Sections 69S to 69ZC) Order 2009.

2 Commencement
  • This order comes into force on 26 June 2009.

3 Dates appointed for purposes of section 69C of Health Act 1956
  • (1) The date appointed for the purposes of section 69C(1) of the Health Act 1956 is 1 July 2012.

    (2) The date appointed for the purposes of section 69C(2) of the Health Act 1956 is 1 July 2012.

    (3) The date appointed for the purposes of section 69C(3) of the Health Act 1956 is 1 July 2013.

    (4) The date appointed for the purposes of section 69C(4) of the Health Act 1956 is 1 July 2014.

    (5) The date appointed for the purposes of section 69C(5) of the Health Act 1956 is 1 July 2015.

    (6) The date appointed for the purposes of section 69C(6) of the Health Act 1956 is 1 July 2016.

    (7) The date appointed for the purposes of section 69C(7) of the Health Act 1956 is 1 July 2016.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 26 June 2009, appoints different dates for the purposes of section 69C(1) to (7) of the Health Act 1956 (the Act). The dates appointed by this order have the effect of deferring by 3 years the general application of sections 69S to 69ZC of the Act to various classes of drinking-water supplier. Those sections impose duties on persons who supply drinking water to people in New Zealand and overseas from drinking-water supplies.

The following table sets out the dates appointed by this order in relation to different classes of drinking-water supplier:

A drinking-water supplier who commences supplying drinking water using a new drinking-water supply that is a large, medium, minor, small, neighbourhood, or rural agricultural drinking-water supply 1 July 2012
A networked supplier or operator of a designated port or airport who uses a large drinking-water supply 1 July 2012
A networked supplier or operator of a designated port or airport who uses a medium drinking-water supply 1 July 2013
A networked supplier or operator of a designated port or airport who uses a minor drinking-water supply 1 July 2014
A networked supplier or operator of a designated port or airport who uses a small drinking-water supply 1 July 2015
A networked supplier or operator of a designated port or airport who uses a neighbourhood drinking-water supply 1 July 2016
A networked supplier or operator of a designated port or airport who uses a rural agricultural drinking-water supply 1 July 2016
