Pursuant to section 175 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the recommendation of the Minister of Fisheries, and on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title

This order is the Fisheries (Akaroa Harbour Taiapure) Amendment Order 2009.

2 Commencement

This order comes into force on 1 October 2009.

3 Principal order amended
4 Schedule amended

(1)

Clause 1(1) of the Schedule is amended by revoking paragraph (c) and substituting the following paragraph:

(c)

proceeding in a generally east by north direction to a point that falls on the line described as the Wainui Leading Lights at 43°54.03′S and 172°57.92′E; then

(2)

Clause 2 of the Schedule is amended by revoking paragraphs (a) to (d) and substituting the following paragraphs:

(a)

commencing at Gateway Point at 43°53.44′S and 172°59.05′E; then

(b)

proceeding in a generally south-westerly direction to a point at 43°53.85′S and 172°54.99′E; then

(c)

proceeding in a generally east by north direction to a point at 43°53.24′S and 173°00.97′E; then

(d)

proceeding in a generally north-westerly direction to Ounuhau Point at 43°53.00′S and 173°00.77′E; then

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 October 2009, amends the Schedule of the Fisheries (Akaroa Harbour Taiapure) Order 2006 to make minor corrections to the description of the Akaroa Harbour Taiapure. The amendments remove a gap between the taiapure and the Pohatu Marine Reserve and correct the description of the boundary between the taiapure and the proposed Dan Rogers Marine Reserve.
