Pursuant to section 32 of the Animal Welfare Act 1999, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the advice of the Minister of Agriculture tendered after consultation with the National Animal Welfare Advisory Committee, makes the following order.


1 Title
  • This order is the Animal Welfare (Leg-hold Traps) Amendment Order 2009.

2 Commencement
  • This order comes into force on the 28th day after the date of its notification in the Gazette.

3 Principal order amended
4 Interpretation
  • Clause 3 is amended by revoking the definition of size 1½ and substituting the following definition:

    size 1½, in relation to a leg-hold trap, means that the greatest distance between the outer edges of the jaws of the trap (measured at right angles to the jaw hinges with the jaws fully open) is between 10.5 and 13.5 centimetres inclusive.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on the 28th day after the date of its notification in the Gazette, amends the Animal Welfare (Leg-hold Traps) Order 2007 by substituting a new definition of size 1½. The new definition clarifies an ambiguity in the way in which a leg-hold trap is measured and introduces some flexibility by including traps that come within the range of 10.5 to 13.5 centimetres.
