This notice is administered by the Ministry of Health.


Pursuant to section 54 of the Health Practitioners Competence Assurance Act 2003, the Minister of Health, being satisfied of the matters set out in section 54(3) of that Act, gives the following notice.

Notice

1 Title
  • This notice is the Health Practitioners (Quality Assurance Activity—Compass Health Wellington Trust) Notice 2010.

2 Commencement
  • This notice comes into force on the day after the date of its notification in the Gazette.

3 Declaration of protected quality assurance activity
  • The Compass Health Wellington Trust Quality Assurance Activity described in the Schedule is a protected quality assurance activity.


Schedule 
Description of Compass Health Wellington Trust Quality Assurance Activity

1 Interpretation
  • In this schedule,—

    activity means the Compass Health Wellington Trust Quality Assurance Activity

    participant means—

    • (a) a health practitioner who is employed by Compass Health Wellington Trust and is participating in the quality assurance activity described in clause 4; or

    • (b) a health practitioner who is not employed by Compass Health Wellington Trust, but who—

      • (i) provides health services on behalf of Compass Health Wellington Trust, or receives management support from Compass Health Wellington Trust; and

      • (ii) is participating in the quality assurance activity described in clause 4.

2 Objective
  • The objective of the activity is to—

    • (a) improve the practices and competence of participants by assessing the health services performed by them; and

    • (b) improve the delivery of health services and outcomes for patients.

3 Information
  • The quality assurance activity described in clause 4 is based on information derived from the participants.

4 Activity
  • The activity involves—

    • (a) conducting clinical audits to review the clinical practice of participants and comparing the results of those audits as between individual participants; and

    • (b) holding peer review meetings to review—

      • (i) individual patient cases:

      • (ii) clinical management:

      • (iii) patient care processes:

      • (iv) any other matters; and

    • (c) identifying and analysing any process or practice that results in an outcome for patients that may, but need not, be an adverse outcome; and

    • (d) making recommendations on how participants can improve their practices and competence so as to—

      • (i) improve the quality of health services they provide; and

      • (ii) improve outcomes for patients; and

      • (iii) reduce the incidence of adverse outcomes; and

    • (e) facilitating and monitoring the implementation of recommendations described in paragraph (d).

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on the day after the date of its notification in the Gazette, declares the Compass Health Wellington Trust Quality Assurance Activity to be a protected quality assurance activity. The effect of this declaration is that—

  • any information that becomes known solely as a result of the activity is confidential; and

  • any documents brought into existence solely for the purposes of the activity are confidential; and

  • the persons who engage in the activity in good faith are immune from civil liability.

The protections afforded by this notice are subject to certain statutory exceptions. For example, this notice does not prohibit the disclosure of information that does not identify, either expressly or by implication, a particular individual.

Under section 54(4) of the Health Practitioners Competence Assurance Act 2003, this notice remains in force for a period of 5 years after the date on which it is issued, unless it is sooner revoked.
