Pursuant to section 52N of the Commerce Act 1986, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Commerce given after receiving a recommendation from the Commerce Commission under section 54M of the Commerce Act 1986, makes the following order.

Order

1 Title
  • This order is the Commerce (Part 4 Regulation––Transpower) Order 2010.

2 Commencement
  • This order comes into force on 1 October 2010.

3 Expiry
  • This order expires with the close of 30 September 2030.

4 Application of individual price-quality regulation to Transpower
  • On and from 1 April 2011, electricity lines services supplied by Transpower are subject to individual price-quality regulation under Part 4 of the Commerce Act 1986.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 1 October 2010 and expires 20 years later, declares that the electricity lines services supplied by Transpower are subject to individual price-quality regulation under Part 4 of the Commerce Act 1986. The individual price-quality path will be set by the Commerce Commission under that Part.

Individual price-quality regulation for Transpower will commence on 1 April 2011, which is the date on which Transpower's pricing year commences. The administrative settlement between the Commerce Commission and Transpower, entered into in May 2008, expires once the Commission has assessed Transpower's compliance with the settlement for the financial year ending 30 June 2011. The administrative settlement will continue in force until its expiry date so that Transpower can submit its final compliance statement, in accordance with the settlement, for the pricing year ending 31 March 2011.

This order is made on the recommendation of the Minister of Commerce, given following receipt of a recommendation by the Commerce Commission under section 54M(3) of the Commerce Act 1986.
