Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 4 October 2010, provide that notice of claim may be given by an insured person to the Earthquake Commission within 3 months of the occurrence of natural disaster damage to property insured under the Earthquake Commission Act 1993. Currently, clause 7(1)(a) of Schedule 3 of that Act sets a standard time limit of within 30 days but provides that a longer time may be prescribed by regulation.
The extended time limit in clause 7(2) of that schedule is unaffected. That time limit is already 3 months.
