Pursuant to section 36(1)(b) and (m) of the Earthquake Commission Act 1993, His Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title
  • These regulations are the Earthquake Commission Amendment Regulations 2010.

2 Commencement
  • These regulations come into force on 4 October 2010.

3 Principal regulations amended
4 New regulation 6 added
  • The following regulation is added:

    6 Longer time for reporting of claims
    • Three months is prescribed as a longer time within which a notice of claim may be given under clause 7(1)(a) of Schedule 3 of the Act.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 4 October 2010, provide that notice of claim may be given by an insured person to the Earthquake Commission within 3 months of the occurrence of natural disaster damage to property insured under the Earthquake Commission Act 1993. Currently, clause 7(1)(a) of Schedule 3 of that Act sets a standard time limit of within 30 days but provides that a longer time may be prescribed by regulation.

The extended time limit in clause 7(2) of that schedule is unaffected. That time limit is already 3 months.
