These regulations are administered by the Department of Internal Affairs.


Pursuant to section 5(1) of the Local Government (Auckland Transitional Provisions) Act 2010, His Excellency the Governor-General makes the following regulations—

  • (a) acting on the advice and with the consent of the Executive Council; and

  • (b) on the recommendation of the Minister of Local Government.

Regulations

1 Title
  • These regulations are the Local Government (Auckland Transitional Provisions) Standing Orders Regulations 2010.

2 Commencement
  • These regulations come into force on 1 November 2010.

3 Revocation
  • These regulations expire, and are revoked, on the close of 31 October 2013.

4 Interpretation
  • In these regulations,—

    Auckland Council means the unitary authority established under section 6 of the Local Government (Auckland Council) Act 2009

    governing body has the same meaning as in section 4(1) of the Local Government (Auckland Council) Act 2009

    local board has the same meaning as in section 4(1) of the Local Government (Auckland Council) Act 2009.

5 Standing orders
  • (1) The standing orders set in accordance with regulation 5(1) of the Local Government (Tamaki Makaurau Reorganisation) Standing Orders Regulations 2010 remain in force until the governing body of the Auckland Council adopts its first standing orders under clause 27 of Schedule 7 of the Local Government Act 2002.

    (2) The standing orders set in accordance with regulation 5(2) of the Local Government (Tamaki Makaurau Reorganisation) Standing Orders Regulations 2010 remain in force for a local board of the Auckland Council until the local board adopts its first standing orders under clause 27 of Schedule 7 of the Local Government Act 2002 (by application of section 29 of the Local Government (Auckland Council) Act 2009.

6 Regulations in place of section 69 of Local Government (Auckland Transitional Provisions ) Act 2010
  • These regulations are in place of section 69 of the Local Government (Auckland Transitional Provisions ) Act 2010.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations continue the standing orders set by the Auckland Transition Agency under regulation 5 of the Local Government (Tamaki Makaurau Reorganisation) Standing Orders Regulations 2010 until the Auckland Council's governing body and local boards adopt their first standing orders under clause 27 of Schedule 7 of the Local Government Act 2002.

The regulations are in place of section 69 of the Local Government (Auckland Transitional Provisions) Act 2010. That section continued any standing orders prescribed under section 46 of the Local Government (Tamaki Makaurau Reorganisation) Act 2009 for the same purpose. However, no orders were made before that section became inoperative under regulation 7 of the Local Government (Tamaki Makaurau Reorganisation) Standing Orders Regulations 2010.

The regulations come into force on 1 November 2010 and expire, and are revoked, on the close of 31 October 2013.
