Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

  • These regulations are the Fisheries (Challenger Area Commercial Fishing) Amendment Regulations 2010.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 16 December 2010, amend the Fisheries (Challenger Area Commercial Fishing) Regulations 1986.

The amendments—

  • revoke regulation 11, which provides that when more than 100 tonnes of snapper have been taken from an area in Tasman Bay and Golden Bay during the period between October and February in the following year, the chief executive of the Ministry of Fisheries is required to close that area to the taking, by commercial fishers, of any fish by pair trawling or Danish seining or of any snapper using a surrounding net that is not a drag net:

  • consequentially omit reference to regulation 11 from regulation 15(1), which prescribes offences for breaches of various provisions of the regulations.
