Pursuant to section 7A(1)(a) of the Tariff Act 1988, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

Order

1 Title
  • This order is the Tariff (Specified AANZFTA Parties—Lao People's Democratic Republic and Cambodia) Amendment Order 2010.

2 Commencement
  • (1) Clause 4(2) comes into force on 4 January 2011.

    (2) The rest of this order comes into force on 1 January 2011.

3 Principal order amended
4 Specified AANZFTA parties
  • (1) Clause 3 is amended by inserting the following paragraph after paragraph (b):

    • (baa) the Lao People's Democratic Republic (also known as Lao PDR or Laos):.

    (2) Clause 3 is amended by revoking paragraph (baa) and substituting the following paragraphs:

    • (baa) Cambodia:

    • (bab) the Lao People's Democratic Republic (also known as Lao PDR or Laos):.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, most of which comes into force on 1 January 2011, amends the Tariff (Specified AANZFTA Parties) Order 2009. The amendments declare the Lao People's Democratic Republic (on 1 January 2011) and Cambodia (on 4 January 2011) to be specified AANZFTA parties (parties to the Agreement Establishing the ASEAN–Australia–New Zealand Free Trade Area (AANZFTA Agreement)) for the purposes of the Tariff Act 1988.

The effect of this order is to—

  • make the preferential tariff rates of duty that apply to specified AANZFTA parties (which are set out in the Tariff) available to the Lao People's Democratic Republic (on and after 1 January 2011) and Cambodia (on and after 4 January 2011); and

  • enable transitional safeguard measures to be applied under the AANZFTA Agreement in appropriate circumstances on imports originating from the Lao People's Democratic Republic or Cambodia.

The Lao People's Democratic Republic and Cambodia are also declared to be specified AANZFTA parties for the purposes of the Customs and Excise Act 1996, under the Customs and Excise (Specified AANZFTA Parties—Lao People's Democratic Republic and Cambodia) Amendment Order 2010.
