Pursuant to section 100A of the Judicature Act 1908, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.


1  Title
  • These regulations are the Court of Appeal Fees Amendment Regulations 2011.

  • These regulations come into force on 1 July 2011.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 July 2011, amend the Court of Appeal Fees Regulations 2001. The amendments adjust the fees payable in respect of civil appeals in the Court of Appeal to reflect the movement in the New Zealand Consumers Price Index (All Groups) since 1 July 2004, except in the case of fees for searching, inspecting, and accessing court documents for which the applicable starting date is 1 February 2010, the date on which those fees became payable.

The fees replaced are inclusive of goods and services tax (GST), but were not amended directly to reflect the 1 October 2010 GST increase, and so differed from those actually charged. The new fees are also GST inclusive.
