Pursuant to section 60 of the Disputes Tribunals Act 1988, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following rules.

Rules

1  Title
  • These rules are the Disputes Tribunals Amendment Rules (No 2) 2011.

2  Commencement
  • These rules come into force on 1 July 2011.

3  Principal rules amended
4  Fees
  • (1) Rule 5(1)(a) is amended by omitting $30 and substituting $36.30.

    (2) Rule 5(1)(b) is amended by omitting $50 and substituting $60.40.

    (3) Rule 5(1)(c) is amended by omitting $100 and substituting $120.80.

Explanatory note

This note is not part of the rules, but is intended to indicate their general effect.

These rules, which come into force on 1 July 2011, amend the Disputes Tribunals Rules 1989. The amendments increase the fees set out in rule 5(1) of the principal rules that are payable to the Tribunal at the time of lodging a claim. The changes reflect the movement in the Consumers Price Index (All Groups) since 1 July 2004.

The fees replaced are inclusive of goods and services tax (GST), but were not amended directly to reflect the 1 October 2010 GST increase, and so differed from those actually charged. The new fees are also GST inclusive.
